Until now, the model was simple.<\/p>\n

Data centers are static.<\/p>\n


<\/p>\n

Under growing pressure from:<\/p>\n


<\/p>\n

\u2013 energy constraints<\/p>\n

\u2013 price differences<\/p>\n


<\/p>\n

a new logic is emerging:<\/p>\n

part of the capacity becomes flexible.<\/p>\n

Including modular.<\/p>\n


<\/p>\n

The problem is not technological.<\/p>\n


<\/p>\n

The problem is logistical.<\/p>\n


<\/p>\n

Moving AI infrastructure is not standard transport.<\/p>\n


<\/p>\n

We are talking about:<\/p>\n


<\/p>\n

\u2013 high-value equipment<\/p>\n

\u2013 sensitive technology<\/p>\n

\u2013 potential dual-use items<\/p>\n


<\/p>\n

This automatically places it under a stricter regulatory regime.<\/p>\n


<\/p>\n

As long as movement stays within a single market \u2013 manageable.<\/p>\n

Once borders are crossed, the customs layer is added.<\/p>\n


<\/p>\n

And this is where the real questions begin:<\/p>\n


<\/p>\n

\u2013 How is a modular data center classified?<\/p>\n

\u2013 Is it temporary export, or something else?<\/p>\n

\u2013 How is equipment that moves cyclically treated?<\/p>\n

\u2013 How does it fall under technology control regimes?<\/p>\n


<\/p>\n

The current framework is designed for goods.<\/p>\n

Not for moving computing capacity.<\/p>\n


<\/p>\n

Yes, there are tools like ATA Carnet.<\/p>\n

They work \u2014 up to a point.<\/p>\n


<\/p>\n

With high-value assets, the limitations become visible.<\/p>\n


<\/p>\n

If we are talking about a module worth around EUR 10 million,<\/p>\n

the required security can reach ~110% of potential customs duties.<\/p>\n


<\/p>\n

This means:<\/p>\n


<\/p>\n

\u2013 a deposit<\/p>\n

\u2013 a bank guarantee<\/p>\n

\u2013 or insurance<\/p>\n


<\/p>\n

In practice, insurance is most often used.<\/p>\n

But it also has limits.<\/p>\n


<\/p>\n

At these levels:<\/p>\n


<\/p>\n

\u2013 additional information may be required<\/p>\n

\u2013 coverage may be restricted<\/p>\n

\u2013 or refused altogether<\/p>\n


<\/p>\n

The tool exists.<\/p>\n

But it was not designed for this type of infrastructure.<\/p>\n


<\/p>\n

Translated into a real scenario:<\/p>\n


<\/p>\n

You have a modular AI unit in the EU.<\/p>\n

An opportunity arises to temporarily relocate it outside the EU for cheaper energy.<\/p>\n


<\/p>\n

Physically \u2013 possible.<\/p>\n

Logistically \u2013 possible.<\/p>\n

From a customs perspective \u2013 this is where the problems begin.<\/p>\n


<\/p>\n

Classification.<\/p>\n

Regime.<\/p>\n

Control.<\/p>\n

Securities.<\/p>\n

Time.<\/p>\n


<\/p>\n

And most importantly:<\/p>\n

Repeatability.<\/p>\n


<\/p>\n

This is not a one-off process.<\/p>\n

This is a model.<\/p>\n


<\/p>\n

And this is where the misalignment appears:<\/p>\n


<\/p>\n

Technology enables movement.<\/p>\n

The framework slows it down.<\/p>\n


<\/p>\n

But the real question goes deeper.<\/p>\n


<\/p>\n

The real asset is not the equipment.<\/p>\n


<\/p>\n

The real asset is:<\/p>\n

computing power and the time<\/p>\n

during which it is operational.<\/p>\n


<\/p>\n

Any delay:<\/p>\n


<\/p>\n

\u2013 logistical<\/p>\n

\u2013 administrative<\/p>\n


<\/p>\n

directly reduces the value of that asset.<\/p>\n


<\/p>\n

Customs regimes are designed to protect value.<\/p>\n

In this case, they start to slow it down and reduce it.<\/p>\n


<\/p>\n

If this model becomes economically viable,<\/p>\n

pressure for new rules will follow:<\/p>\n


<\/p>\n

regimes that treat this infrastructure not as goods,<\/p>\n

but as mobile production capacity.<\/p>\n


<\/p>\n

Otherwise:<\/p>\n


<\/p>\n

\u201ccompute follows energy\u201d will remain true as an idea.<\/p>\n

But limited in practice.<\/p>\n
